Welcome to Atelier (“Atelier,” “we,” “us,” or “our”).
By accessing or using the Atelier mobile application or website (the “Platform”), you agree to be bound by these Terms of Use.
If you do not agree, you may not use the Platform.
2. Description of the Platform
Atelier is a curated platform that connects creative professionals (“Creatives”) with opportunity providers (“Clients”).
Atelier facilitates introductions and communication between users.
Atelier:
Is not an employer
Is not a staffing agency
Is not a party to agreements between users
Does not supervise projects
Does not guarantee payment
Does not provide escrow services
All project terms, scope, pricing, and payment arrangements are determined solely between users.
3. Eligibility
You must be at least 18 years old to use Atelier.
By creating an account, you represent that:
You have the legal capacity to enter contracts
The information you provide is accurate
You will maintain the confidentiality of your login credentials
4. User Accounts
You are responsible for:
Maintaining account security
All activity under your account
Ensuring your profile information remains accurate
We reserve the right to suspend or terminate accounts at our discretion.
5. Membership & Fees
Atelier may offer paid membership subscriptions.
By purchasing a membership:
You authorize recurring billing via Stripe.
Membership renews automatically unless canceled.
You may cancel at any time through your account.
Fees are non-refundable except where required by law.
Atelier may modify pricing with advance notice.
6. Payments Between Users
Atelier does not process, hold, or guarantee payments between Creatives and Clients for project work.
Users are solely responsible for:
Negotiating project terms
Executing agreements
Invoicing and payment collection
Handling disputes
Atelier is not liable for:
Non-payment
Partial payment
Delayed payment
Contract breaches
Project dissatisfaction
7. User Conduct
You agree not to:
Provide false or misleading information
Harass, exploit, or misrepresent yourself
Violate intellectual property rights
Circumvent membership requirements
Use the Platform for unlawful purposes
We reserve the right to remove content or terminate accounts for violations.
8. Intellectual Property
Users retain ownership of their content.
By posting content on Atelier, you grant Atelier a limited, non-exclusive license to display such content for the purpose of operating the Platform.
9. Disclaimer of Warranties
The Platform is provided “as is” and “as available.”
Atelier makes no guarantees regarding:
Job placement
Project success
Revenue generation
Platform uptime
User reliability
10. Limitation of Liability
To the maximum extent permitted by law, Atelier shall not be liable for:
Indirect or consequential damages
Lost profits
Disputes between users
Payment issues
Contract disputes
Your use of the Platform is at your own risk.
11. Termination
We may suspend or terminate your access at any time for violation of these Terms.
You may terminate your account at any time.
12. Changes to Terms
We may update these Terms from time to time. Continued use of the Platform constitutes acceptance of revised Terms.
